Data processing agreement
This agreement applies when a business uses Loyever to run a loyalty card, and forms part of the service terms. Version 2026-09-15.
Who does what
Your business is the controller of your members’ personal data. Loyever is the processor: it processes that data only on your instructions, to run your loyalty card, show it in Apple Wallet and Google Wallet, and send the messages you choose.
For businesses in Azerbaijan, Loyever is provided by the sole trader Elvin Latifzada (VÖEN 1605412122).
The data and why it is processed
Members’ first name, birthday (day and month only), optional email address, their choice about offers, their card activity (visits, stamps or points, rewards), and the Wallet device identifiers and push tokens that keep the card up to date.
It is processed only to run your loyalty programme for as long as you use Loyever. When you close your account, member data is deleted after the 90-day grace period.
What Loyever commits to
Only people who need the data to run the service can reach it, and they are bound to confidentiality.
Data is encrypted in transit, pass tokens and API keys are stored hashed, access is controlled and logged, and backups are kept for 14 days.
Loyever helps you answer members’ requests. Every pass carries a “Remove my data” link that erases the member and voids the card.
Loyever tells you without undue delay about a personal data breach that affects your members.
When the service ends, member data is deleted; you can export it before that at any time.
Sub-processors
Hetzner Online GmbH (hosting, Germany); Cloudflare, Inc. (network delivery and bot protection); Apple Inc. and Google LLC (delivering and updating Wallet cards); ImprovMX (email delivery).
Loyever tells you before it adds or replaces a sub-processor, and you can object.
Where data goes
Member data is stored in Germany (EU). Cloudflare, Apple and Google may process it outside Azerbaijan and the EU, including in the United States, under their own data protection terms.
Your part
You make sure you may collect members’ data for your loyalty card, and you keep the member privacy notice that Loyever generates for your join page up to date with your details.
